Terms of Service

1. Agreement to terms

By accessing or using aiOS (“the Service”), a product of aiOS by AI Genesis LLC (“we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

aiOS is an AI-powered operating system that provides automated agents for personal productivity, content creation, marketing, sales, customer support, and other business operations. The Service analyzes publicly available information from your website and generates content and strategies using AI. aiOS may be controlled via iMessage, web dashboard, or API.

3. Accounts and access

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your credentials
  • One account per person; accounts are non-transferable
  • You must be at least 18 years old to use the Service
  • We may suspend or terminate accounts that violate these Terms

4. Free trial

New accounts receive 5 free Try messages before signup is required. No credit card is required during Try. After the free messages are used, you must create an account and choose a paid plan to continue.

5. Billing and payments

  • Try: 5 free messages before account creation (no daily reset)
  • Paid plans: Basic $20/mo, Plus $49/mo, Pro $100/mo, Ultra $200/mo (monthly message bundles with optional pay-as-you-go overage)
  • Subscriptions are billed monthly via Stripe; Enterprise is custom
  • Soft spending ceilings and optional hard caps apply per plan (see in-product billing settings)
  • You may cancel at any time; rollover applies up to 3× your monthly bundle on paid tiers
  • Refunds are at our discretion and evaluated on a case-by-case basis
  • Prices may change with 30 days' notice

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Generate spam, phishing, or deceptive content
  • Attempt to access other users' data or accounts
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated scripts to access the Service (beyond our official APIs)
  • Exceed rate limits or abuse our infrastructure
  • Impersonate another person or entity
  • Transmit malware, viruses, or harmful code
  • Use AI-generated voice or likeness to impersonate real individuals without their consent
  • Use the Service to generate content that violates third-party platform terms (e.g., Meta, LinkedIn, Google)

7. AI-generated content

  • Content generated by AI agents is provided “as-is”
  • You are responsible for reviewing and approving all generated content before use
  • We do not guarantee the accuracy, completeness, or appropriateness of AI outputs
  • You own the content generated for your account, subject to underlying AI model terms
  • AI-generated images, video, and audio are subject to the respective model provider's usage policies
  • We may use anonymized, aggregated usage data to improve the Service

8. iMessage and messaging relay

aiOS enables control of AI agents via iMessage and SMS. When you use this feature:

  • Messages are transmitted through third-party messaging providers (currently Linq)
  • Message content is processed by AI to execute your requested actions
  • We store conversation history to maintain context and improve the Service
  • Standard carrier messaging rates may apply
  • You consent to receive automated responses from our AI agents at the phone number you provide
  • You may stop messaging at any time by texting STOP

9. Voice AI and call recording

aiOS may make or receive phone calls on your behalf using AI voice technology. When you use voice features:

  • Calls may be recorded for quality assurance and to provide transcripts
  • AI voice agents will identify themselves as AI at the start of each call
  • Call recordings are stored securely and retained for 90 days unless you request earlier deletion
  • You are responsible for compliance with local call recording consent laws in your jurisdiction

10. Workspaces and compute resources

Certain aiOS features provision isolated compute environments (“Workspaces”) to execute tasks on your behalf.

  • Workspaces are dedicated to your account and isolated from other users
  • You may not use Workspaces for cryptocurrency mining, DDoS attacks, or other abusive purposes
  • We reserve the right to suspend Workspaces that consume excessive resources or violate these Terms
  • Data within Workspaces is deleted within 30 days of account termination

11. Connected services

When you connect third-party accounts (social media, email, CRM, etc.), you authorize us to access and act on those accounts within the scope you grant. You may disconnect any service at any time. We are not responsible for changes in third-party APIs or policies that may affect functionality.

12. Budgeting features

Not financial advice. aiOS budgeting features (including account balances, spending summaries, recurring-charge detection, fee alerts, and low-balance warnings) are provided for informational and personal budgeting purposes only. They do not constitute financial, investment, tax, legal, or accounting advice, and aiOS is not a fiduciary, financial planner, investment adviser, broker-dealer, tax preparer, or credit counselor. You should consult a qualified, licensed professional before making financial decisions.

Read-only access. Bank account connections are read-only, provided through SimpleFIN, an independent third-party service with its own terms and fees that you contract with directly. aiOS cannot initiate payments, transfers, or any transaction on your accounts, and never receives your bank login credentials.

Accuracy. Balances and transactions are supplied by your financial institution through SimpleFIN and may be delayed, incomplete, or inaccurate. Derived figures (spending summaries, projections, recurring-charge and fee detection) are estimates computed from that data and may not reflect your actual financial position. Low-balance and overdraft warnings are predictions, not guarantees; you remain solely responsible for monitoring your accounts and avoiding overdrafts or missed payments.

Your responsibilities. You may only connect accounts you own or are authorized to access. You are responsible for maintaining your SimpleFIN account and for reviewing information before acting on it.

Data and disconnection. Financial data handling is described in the financial account data section of our Privacy Policy. You may disconnect at any time, which permanently deletes your connection and synced financial data from aiOS.

Limitation. To the maximum extent permitted by law, aiOS disclaims all liability for decisions made or actions taken in reliance on budgeting features, and for losses arising from data inaccuracies, delays, or unavailability of third-party services.

13. Intellectual property

“aiOS” and the aiOS logo are trademarks of AI Genesis LLC. The Service, including its design, code, AI models (excluding third-party models), and documentation, is our intellectual property. You may not use our trademarks without prior written consent. Nothing in these Terms grants you rights to our intellectual property except the limited right to use the Service as described herein.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI GENESIS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE.

16. Indemnification

You agree to indemnify and hold harmless aiOS by AI Genesis LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

17. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

18. Changes to terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use after changes take effect constitutes acceptance.
